Just to correct the usually precise Adriatica.
it is not a requirement to be a member of FIMAA or FIAIP, as long as you are registered as an agent at the Camera di Commercio you can practise legally. However if you are not a member of one or the other you must have a separate insurance package - whereas you get indemnity insurance if you pay one of the professional bodies.

With or without membership of a professional body it does seem to be the case that some estate agents are apparently ignoring codes of ethics and possibly the law. The fact that one of them from whom I have bought my property is covering large parts of Abruzzo is worrying, given the region's increasing popularity with Brits. Also of concern, since it gives an air of security, is that the agent claims to be UK based.

The Property Consultant for the agency has repeatedly told me that the compravendita is the only document now supplied at a house purchase (I'd had to pester for six weeks to get even that). I have now had to make a personal visit to the Catasto to obtain copies of all the visuras to make sure that indeed the properties and land have all been registered in my name, (they have). But I am concerned that other documents like the original deeds &c are being retained somewhere unspecified, it would be useful to know what is the truth.

Because the italian FIAIP-registered estate agent used the Procura Speciale to complete the purchase for me, until I read it in the Compravendita, I was unaware of the fact that my second property was built illegally and only condoned by the Comune to warehouse/magazino status (C2). The fact that it was operated illegally as a Pizzeria for ten years and was in the process of being converted to habitation - again illegally, should also, I guess, have been pointed out to me by either the agent or the lawyer. The fact that this avvocato linked to the estate agent, who facilitated the preliminary contract and who received €1,000 fee for his services to me, failed to supply any search documents and building permissions, despite promises to do so, is alarming, since this arrangement is apparently used frequently.

Adriatica's extremely useful post will enable me seriously to consider taking this further and I am very grateful to her for that. Clearly I made a mistake in not using an independent lawyer and am happy to offer that as the main lesson to be identified for anyone else contemplating a similar purchase.

We too got ourselves into a tangle ( in our case over ownership of a particular part of the property).Won't wash our dirty linen in public but it took us 3 years to sort out.Fortunately all turned out for the best in our case but I would echo Barn Elms advice:

1) If you have not passed money over ,then do not.Whatever Italian law says it is very difficult and expensive to try to get it back

2) If you have paid a deposit,then don't panic but forget the renovation plans and dreams you have for the moment ,put in the back of your mind that the money may be lost,and focus exclusively on how to resolve the problem that you have.
Hope this doesn't sound too negative,but honestly believe one step at a time is the way to go and always be mentally prepared to walk away if necessary
