British student Meredith Kercher was killed without premeditation and in the absence of any feelings of rancour towards her on the part of the perpetrators, says the long-awaited Judges’ report. The 427-page report, published on Friday and signed by trial judge Giancarlo Massei and his co-judge Beatrice Cristiani, states that there were no inconsistencies or gaps in the trial procedure and that Knox and her boyfriend Raffaele Sollecito were convicted primarily on forensic evidence.

The Judges say that a combination of random circumstances led to Kercher’s murder: Knox and Sollecito happened to meet Guede on the night of November 1st 2007 and took him to the house that Knox shared with Kercher, where the British student was alone. There, according to the report, Guede made a sexual advance to Kercher, which she repelled. Under the influence of drugs, Knox and Sollecito then decided to “help” Guede make Kercher, who had been drinking, submit. Kercher fought back and a scene of horrific violence followed. Knox finally killed Kercher with a kitchen knife.

Knox, now 26, and Sollecito, now 25, were sentenced respectively to 26 and 25 years’ imprisonment. Knox received the extra year because she had knowingly accused an innocent man, Patrick Lumumba, of the murder. Lumumba spent two weeks in prison before being cleared.
Guede was found guilty of the murder in a fast-track trial behind closed doors in 2008 and was sentenced to 30 years’ imprisonment. This was reduced to 16 years upon appeal. He still maintains that he is innocent.

The publication of the Judges’ report paves the way for Knox’s first appeal to take place. Under Italian law a convicted person is allowed two appeals.

JUST DON'T KNOW IF SHE IS GUILTY OR NOT

I try to make a unbiased decision of whether she is guilty or not but there is so much conflicting information/ misinformation from both the prosecutor and the defense, it makes it really hard to decide. This whole case is a travesty b/c the media got involved so the SPIN is ENDLESS from both sides. It's disgusting if you ask me.

i think Amanda Knox was involved or at least there when the murder happened.
i don't think there is enough evidence to convict her of murder but she should be convected for obstructing justice. I think she is pretty and i have been reading all i can about the case. She is addicting.

Footprints

I've researched all the evidence and it seems like there is so much conflicting evidence. what one source says, there is another saying its not true.

WERE SOME OF THE FOOTPRINTS THAT WERE FOUND AT THE SCENE VERIFIED AS BELONGING TO AMANDA KNOX??????????

If they were, then the debate is over, simple as that.

So, in the end she was killed because of the influence of alcohol? I am sorry, but I refuse to believe that alcoholic people are irresponsible, I think they know what they are doing only that they don't have any censorship on their acts. Now Meredith is just another number added to the statistics of those who've been killed by people under alcohol influence. Unfortunately for Amanda she's not going in drug rehab Utah, her mistake can't be fixed now.

The prosecutor that convicted Amanda and Raffaele was convicted of abuse of power in January 2010 and asinine satanic cult related charges he made against 20 people were dropped in April 2010 due to a lack of evidence. He is now officially a criminal and free to abuse more people.

Amanda Knox and Raffaele Sollecito repeatedly told the police what they were doing the evening Meredith was killed by Guede however they could not remember exactly what time they did this that or the other so the police accused them of lying.

On 5 November 2007, Knox and Sollecito were interrogated / tormented all night and manipulated by the police so they could be arrested.

Sollecito?s alibi was confirmed by computer forensic evidence which indicated he downloaded a cartoon at 9:10 pm and watched the cartoon until 9:46 pm. The coroner?s report indicated Meredith was killed no later than 9 pm so it was ignored and an imaginary time of death of 11:31 pm was established.

Later the crime lab destroyed three hard drives by applying too much voltage so the hard drives can?t be examined unless they are repaired, but the repair has not been allowed.

Raffaele?s mobile phone records established the exact time he used his phone so his guessing about the time he used his phone was said to be lies.

A girl visited Raffaele?s apartment at 8:40 pm and Amanda greeted her at the door. Meredith returned home about 8:54 pm and did not realize Guede was in the apartment. Guede attacked Meredith at 8:56 pm as she was calling her mom from her bedroom. The call was interrupted in less than 5 seconds after it was made.

The police thought Diya Lumumba murdered Meredith so they tormented Amanda to agreeing with them then arrested him immediately because they thought it would make them look good but it turned out he was innocent so they put the blame on Amanda to cover their incompetence. She recant her her statement against Lumumba immediately after it was coerced from her.

Knox?s account of what happened on 2 November 2007 is not contradicted by her mobile phone records although she did not remember the exact time she used her phone. She forgot what time she called her mother so the police made a big deal out of it. Amanda used her phone 15 times Nov 2.

Amanda Knox and Raffaele Sollecito both gave the same alibis until the police had their way with them but after the horrific interrogations they immediately went back to their original alibi. Both Knox and Sollecito have credible alibis for the night of the murder despite all the lies told about them.
Guede washed up in the bathroom after killing Meredith, returned to Meredith?s room, stepped in her blood, took her money, took her phones, covered her body, and lock Meredith?s door.
Guede?s DNA was found on and in Meredith and his bloody footprints lead straight out of Meredith?s room and out of the house. Many people tracked through his bloody shoe prints before they knew they were there.

Guede scale the window bars below Filomena?s room to gain access through her bedroom window. The break-in was clearly a burglary.

The rock made a gouge on a shutter mounted on the inside of the window and glass scattered all over Filomena?s room. This indicates that the window was not busted from inside the room.

Guede had no reason to stage the break-in because he actually broke in.

The scientific police did not find a mixture of Amanda Knox?s DNA and Meredith?s blood on the floor. The police found some spots on the floor that glowed when tested but they did not verify it was Meredith?s blood or that it was blood at all. Test to verify it was blood should have been performed but the police said the test were not performed. Who knows?

There is physical evidence that Rudy Guede went into the blood-spattered bathroom. However, the scientific police did not find any credible evidence that Knox and Sollecito tracked Meredith?s blood into this bathroom. Logically the bloody foot print on the bath mat was made by Guede because the evidence proves he was the only person at the crime scene. The partial foot print was not of sufficient quality to be identified so the police said it belonged to Raffaele although this is not logical.

Surprise, Amanda Knox?s DNA was found in the bathroom she used every day. After Guede got Meredith?s blood on the surfaces in the bathroom it mingled with Amanda?s DNA in three different places in the bathroom: on the ledge of the basin, on the bidet, and on a box of Q Tips cotton swabs. The police accused Amanda and Raffaele of cleaning up however the bathroom was not cleaned so why would someone clean up and not clean up the bathroom? Also there was no evidence of clean up offered to the court. I only know of the police saying they suspected clean up with bleach, however bleach glows blue the same as blood and if the place had been cleaned with bleach the entire area would have glowed blue. This did not happen.

Guede left a visible bloody footprint on the blue bathmat.

Guede left a partial bloody shoe-print on the pillow under Meredith?s body so the police said it belonged to Amanda however it did not match any of her shoes and none of her shoes tested positive for traces of blood. Also how would it be possible for someone to leave only one shoe print unless they can fly? It?s not.

The police said Knox?s and Sollecito?s bare bloody footprints were revealed by luminol in the hallway. It was said Knox?s DNA and Meredith?s DNA was found mixed together in one of the bloody footprints / blurs, however the samples tested were not conclusive.

A small amount of Raffaele Sollecito?s DNA was found only on the metal portion of Meredith?s bra clasp, along with the DNA of three unknown people after it was walked on, kicked around then found in a pile of dust 47 days after the murder. Where did the DNA from three unknown people come from? They were not at the crime scene.

Amanda Knox?s DNA was found on the handle of the double DNA knife and a number of highly respected forensic experts dispute the validity of the test for Meredith?s DNA which violated procedure.

The police told Raffaele that Meredith?s DNA was on the blade. They were threatening Raffaele with prison which is why he lied about accidentally pricking her hand whilst cooking.

The defense experts were unable to prove that there had been contamination although the performance of the police was so bad that to say it was sloppy would be a compliment. The police forensic science unit, pointed out that contamination (although contamination is obvious) must be proved or it does not exist.

Amanda Knox was told to imagine that she was in the apartment when Meredith was murder and the police coerced her to write a note to the police on 6 November 2007. Also she wrote a note immediately after her interrogation that said she did not think what she was coerced to say was true. She stated on many occasions that she was not at the cottage when Meredith was killed. She also claimed that Sollecito was at his apartment with her all evening.

How could one person hold and stab meredith on either side of her throat and for meredith not to have few defense wounds and not dna under her nails. There had to be at least one other person there.

This is ridiculous.

This whole case has become a witch hunt, and Amanda Knox has been branded the witch. There is no hard evidence against her. I have read countless articles and testimonies, and sifted through a seemingly unending pile of biased bullshit (from BOTH sides) about this horrible crime, and have come to the conclusion that the authorities have no idea what actually happened that night.

REGARDLESS of whether Amanda was involved in some way in this horrible tragedy, there is absolutely no evidence to prove she herself murdered Meredith Kercher. There is none. And in case all of you witch-hunters have forgotten, she was convicted of murder, and that is a horrifying injustice.

Personally, I believe Amanda was in her home that night, though I believe she was under the influence of a much harder drug than the marijuana she admitted to smoking. Whether she took it voluntarily or not, who knows, but based on her accounts of the night (yes, both of them), I believe she was there during the murder, but that she is genuinely unsure of it, and confused as to what actually happened.

The Judges' Sentencing Report

The evidence against Amanda Knox and Raffaele Sollecito is overwhelming.

Amanda Knox’s DNA was found on:

1. On the double DNA knife and a number of independent forensic experts - Dr. Patrizia Stefanoni, Dr. Renato Biondo and Professor Francesca Torricelli - categorically stated that Meredith’s DNA was on the blade.

2. Mixed with Meredith’s blood on the ledge of the basin.

3. Mixed with Meredith’s blood on the bidet.

4. Mixed with Meredith blood on a box of Q Tip cotton swabs.

5. Mixed with Meredith’s blood in the hallway.

6. Mixed with Meredith’s blood on the floor of Filomena’s room, where the break-in was staged.

7. On Meredith’s bra according to Dr. Stefanoni AND Raffaele Sollecito’s forensic expert, Professor Vinci.

Amanda Knox’s footprints were found set in Meredith’s blood in two places in the hallway of the new wing of the cottage. One print was exiting her own room, and one print was outside Meredith’s room, facing into the room. These bloody footprints were only revealed under luminol.

A woman’s bloody shoeprint, which matched Amanda Knox’s foot size, was found on a pillow under Meredith’s body. The bloody shoeprint was incompatible with Meredith’s shoe size.

Two independent imprint experts categorically excluded the possibility that the bloody footprint on the blue bathmat could belong to Rudy Guede. Lorenzo Rinaldi stated:

“You can see clearly that this bloody footprint on the rug does not belong to Mr. Guede, but you can see that it is compatible with Sollecito.”

The other imprint expert print expert testified that the bloody footprint on the blue bathmat matched the precise characteristics of Sollecito’s foot.

An abundant amount of Raffaele Sollecito's DNA was found on Meredith's bra clasp. Sollecito must have applied considerable pressure to the clasp in order to have left so much DNA. The hooks on the clasp were damaged which confirms that Sollecito had gripped them tightly.

According to Judge Massei and Judge Cristiani, Rudy Guede's visible bloody footprints lead straight out of Meredith's room and out of the house. He didn't lock Meredith's door, remove his trainers, go into Filomena's room or the bathroom that Meredith and Knox shared.

He didn't scale the vertical wall outside Filomena's room or gain access through the window. The break-in was clearly staged. This indicates that somebody who lived at the cottage was trying to deflect attention away from themselves and give the impression that a stranger had broken in and killed Meredith.

Guede had no reason to stage the break-in and there was no physical evidence that he went into Filomena's room or the bathroom. The scientific police found a mixture of Knox's DNA and Meredith's blood on the floor in Filomena's room. They also found irrefutable proof that Knox and Sollecito had tracked Meredith's blood into the bathroom.

The murder dynamic implicates Knox and Sollecito.

Barbie Nadeau wrote the following:

"Countless forensic experts, including those who performed the autopsies on Kercher's body, have testified that more than one person killed her based on the size and location of her injuries and the fact that she didn't fight back—no hair or skin was found under her fingernails."

Judge Paolo Micheli claimed that Amanda Knox and Raffaele Sollecito knew precise details about Meredith's murder that they could have only known if they were present when she was killed.

Amanda Knox voluntarily admitted that she involved in Meredith's murder in her handwritten note to the police on 6 November 2007. She stated on at least four separate occasions that she was at the cottage when Meredith was killed. She also claimed that Sollecito was at the cottage.

Amanda Knox and Raffaele Sollecito both gave multiple conflicting alibis and lied repeatedly. Their lies were exposed by telephone and computer records, and by CCTV footage. Neither Knox nor Sollecito have credible alibis for the night of the murder despite three attempt each. At the trial, Sollecito refused to corroborate Knox's alibi that she was at his apartment.

Legal expert Stefano Maffei stated the following:

"There were 19 judges who looked at the evidence over the course of two years, faced with decisions on pre-trial detention, review of such detention, committal to trial, judgment on criminal responsibility. They all agreed, at all times, that the evidence was overwhelming.

i dont think she is innocent. if she was she would n't have lied to begin with and even now continues to lie. as the latest ALessi's confessions in the news. american people the way they have shown their real prejudice in this case , that they will go as far as ignore the brutal and cruel tragic death of meredith for an american woman who is this cruel person amanda. all circumstantial and forensic evidense prove it. but just becuz she is a white american they will not accept it. just answer 2 question. aside from lying her story of being there, why did she had to literally name an innocent person for the murder if she is really innocent? secondly why wuld this guede had not named this mystery 4th person to avoiod or have lesser jail sentence? in every murder case the gulity always says that there is no evidence, infact do u know any murderer who ever admits to their guilt? amanda and her boyfriend and her low class parents are nothing but socio path liars

i dont think she is innocent.

I am a white American woman and very proud to be so... But that does not mean I agree with the Knox's I and alot of others believe she is guilty as sin and think that she should of been hanged or worse for her crime along with RS and RG I hope that none of them especially AK gets a sentence reduction....I also think that the Knox's raise a socialpathic lier and killer. I honestly dont think none of the Knox's would know the truth if it hit them at 190 miles an hour right in the face.
I also think that any moneys made from books,movies or law suits should go to the Kercher's and not the Knox's. So when you say the American's please do not include all of us for most of us still love and dream of Italy as the romantic country that it protrays.

Read "The Monster of Florence" and you will know that the chief prosecutor of Perugia was on some kind of witch hunt and there never was any forensic evidence against Amanda Knox or her boyfriend. Mr. Mignini has made Italian jurisprudence the laughingstock of international law. It is sad that so many innocent people have to suffer because of his ego.
